This market will resolve to “Yes” if a formal application is filed at Germany’s Federal Constitutional Court (Bundesverfassungsgericht) seeking to ban the political party Alternative für Deutschland (AfD) or requesting that the Court assess the constitutionality of the political party as part of a process that could lead to the party’s ban under Article 21(2) of the German Basic Law by December 31, 2025 11:59 PM ET. Otherwise, this market will resolve to “No”. The application must be officially lodged by one of the eligible entities: the Bundestag, the Bundesrat, or the Federal Government. This market does not require that the court accept or rule on the application—only that it is formally filed. The resolution source will be a consensus of credible reporting.

The current governing coalition consists of the CDU/CSU with 28.5% of the vote and the SPD with 16.4%. AfD at 20.8, with a current trend of 23-25%. The SPD is on the left - the CDU is centre to right. So basically, the SPD can shoot past the CDU against the AfD as much as it wants, while the CDU cannot. In my opinion, this is just pretention, as they did for month now. There's nothing to be gained. If they file the lawsuit, they can't take it back. So either the AfD is banned, which would deprive 25% of all voters of the right to democracy, or it is not banned and uses this wave of ‘democratic legality’ to win more and more votes.

Lets take the words literally. They decided to prepare the appeal. After that they need to actually do it. Then they need to convince the CDU to sign up on it and then actually send it in. SO we are 4 steps away for now.

I think it is very unlikely that a formal application will be made, simply because they are currently acting as if the party is already banned. Party officials are uninvited to appointments. The public broadcaster would like to uninvite the AfD in future. If an application is filed and the court decides against a ban, then there is nothing left to hold against the party.
